Data Protection Officer

According to the definition in Article 37 of the GDPR, the appointment of a data protection officer for the Johann Strauss Society Vienna is not required and therefore has not taken place.

 

Purposes of processing and related legal bases

You can contact us by mail, telephone, or email at our association’s headquarters (see above) or get in touch with us during the registration deadlines for events using the contact details provided on the respective event invitation. In both cases, the data transmitted to us is subject to the GDPR/DSV and the TKG and will only be used for the purpose of addressing your inquiries. The same applies if you contact us via Facebook (johann strauss-gesellschaft wien), although in this case, the privacy policy of Facebook’s operator also applies: Facebook Ireland Ltd, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland.

As a general rule, we do not process personal data for the purpose of automated decision-making as defined in Article 22 of the GDPR.

If an event is held in cooperation with another institution (theater, concert organizer, etc.), the privacy policy of the cooperation partner also applies to the respective organizational areas.

 

Recipients or categories of recipients of personal data

To provide our services, data may be shared with third parties who act on our behalf to fulfill your order (e.g., shipping companies, banks, payment processors). In such cases, the transfer of data always occurs in consultation with our respective client.

 

Criteria for data storage duration

Regarding the duration of the storage of personal data, the following applies:

1. For members of the Johann Strauss Society Vienna, contractual partners, and those interested in our work who have requested continuous information about our events, data will be stored until further notice;
2. for all other communication partners, data will be stored until the respective request has been processed, and for a longer period only if contractual obligations arise.
3. Furthermore, data may be stored for a longer period at the request of the communication partner, provided that further record-keeping is expressly desired by the communication partner.
4. Data that must be stored for longer periods due to statutory retention requirements or where there are legitimate interests in further processing, in particular for the establishment, exercise, or defense of legal claims, is not affected by these criteria.

 

Data subject rights

Within the framework of the legal provisions, members of the Johann Strauss Society Vienna, its contractual partners, interested parties in the work of the Society and other communication partners have the following rights with regard to their personal data in accordance with Articles 15 to 21 GDPR:

3. Right to erasure,
4. Right to restriction of processing,
5. Right to object to data processing carried out on the basis of legitimate or public interests [Art. 6 (1) lit. e or f GDPR], insofar as this objection is lodged on grounds relating to a particular personal situation,
6. Right to data portability with regard to the personal data provided to us,
7. Right to withdraw consent to data processing. However, such withdrawal does not affect the lawfulness of processing based on consent before its withdrawal.
8. Right to lodge a complaint with the competent supervisory authority if you believe that we have violated data protection rights or have not sufficiently implemented data subject rights. The competent supervisory authority is the Austrian Data Protection Authority, Barichgasse 40-42, A-1030 Vienna, dsb.gv.at

 

Obligation to provide data and possible consequences of non-provision

The Johann Strauss Society of Vienna, as a non-profit organization, is eligible for tax-deductible donations in accordance with Section 4a Paragraph 4 of the Austrian Income Tax Act of 1988. A donation can only be claimed as a tax deduction if the donation amount has been credited to the Johann Strauss Society of Vienna’s account and the donor authorizes the Society to disclose the donation amount, their name, and date of birth to the tax authorities. If the donor refuses this authorization, the donation cannot be claimed as a tax deduction.
